Terms of Service

1. Campaign Website; No NATCA or Employer Endorsement

This website is operated by the Campaign. It is not operated by NATCA, any NATCA local or affiliate, or any employer, unless the Campaign specifically states otherwise in a written notice approved under applicable NATCA rules.

The Campaign does not represent that NATCA or any employer endorses, sponsors, authorizes, funds, or administers the Campaign. Use of NATCA’s name or references to NATCA’s organization, regions, facilities, or offices does not by itself imply NATCA endorsement.

The Campaign will use NATCA names, marks, photographs, logos, and other protected materials only to the extent authorized or legally permitted.

2. Lawful Use

You may use the website only for lawful purposes. You agree not to:

• Interfere with or disrupt the website or its security;

• Attempt to access nonpublic systems, accounts, or data;

• Submit false, fraudulent, or misleading information;

• Use the website to distribute malware, spam, or unlawful material;

• Scrape, harvest, or misuse information obtained through the website;

• Impersonate another person or organization; or

• Use the website in a manner that violates another person’s rights or applicable law.

The Campaign may suspend or restrict access when reasonably necessary to protect the website, Campaign systems, users, or operations.

3. Voluntary Donations

Any donation made through the website is voluntary. A donation is not required to:

• Use the website;

• Purchase merchandise;

• Communicate with the Campaign;

• Participate in NATCA;

• Vote in a NATCA election; or

• Receive any Campaign service or benefit.

The Campaign will not condition merchandise availability or website access on making a donation.

Before accepting donations, the Campaign will comply with applicable NATCA election rules, Election Campaign Guidance, contribution restrictions, disclosure requirements, and recordkeeping requirements. The Campaign will not knowingly accept money or anything of value from a prohibited source or use NATCA or employer funds, facilities, personnel, equipment, mailing lists, communication systems, or other resources for campaign promotion except as specifically authorized.

The 2021 NATCA election rules required candidates to comply with the LMRDA, NATCA Election Campaign Guidance, and NATCA rules, and prohibited seeking or accepting endorsements from individuals or entities outside NATCA. Because 2027 rules have not yet been published, the Campaign will follow the current rules when issued and will revise these Terms if necessary.

4. Merchandise Orders and Payments

Merchandise purchases are voluntary. Prices, shipping charges, and applicable taxes will be shown during checkout or otherwise disclosed before an order is submitted.

By placing an order, you authorize the payment processor to process the amount shown at checkout. Stripe or another identified payment processor handles payment information. The Campaign does not store full payment-card or bank-account details in its systems, to the extent that accurately describes the payment flow.

Returns, refunds, cancellations, exchanges, damaged or incorrect items, shipping, processing times, and address changes for merchandise orders are governed exclusively by the Campaign’s Refund and Order Policy. This section does not create any refund, return, or exchange rights, and the Refund and Order Policy controls if the two documents differ on a store-order matter.

5. User Submissions

You retain ownership of comments, questions, photographs, and other content you submit. By submitting content, you grant the Campaign a nonexclusive, royalty-free permission to receive, store, review, reproduce, and use that content as reasonably necessary to:

• Administer the website;

• Respond to you;

• Conduct Campaign operations;

• Communicate about the Campaign; and

• Comply with law or applicable NATCA rules.

The Campaign will handle personal information in accordance with its Privacy Policy. Do not submit confidential, privileged, unlawful, or highly sensitive information. The Campaign may remove or decline to use a submission when reasonably necessary.

6. Privacy

The Campaign’s collection, use, retention, and disclosure of information are described in the Sanchez for Southwest Campaign Privacy Policy, which is incorporated into these Terms by reference.

The Campaign does not require an account or login. Privacy requests may be submitted by emailing alex@s4sw.org. The separate Data Request and Deletion Policy describes the request process.

7. Third-Party Services and Links

The website may link to or use third-party services, including Stripe, hosting providers, database providers, email and messaging providers, Cloudflare, Meta, TikTok, Google, Facebook, Instagram, YouTube, shipping providers, and security services.

The Campaign uses Facebook, Instagram, TikTok, and YouTube’s in-platform advertising and audience-targeting tools. The Campaign may target audiences in Oklahoma, Texas, New Mexico, Alaska, and Louisiana, including age and professional or job-title criteria. The platforms independently control their own services, data practices, terms, and advertising systems.

The Campaign does not control third-party services and is not responsible for their independent terms, privacy practices, availability, security, or content.

8. Intellectual Property

The website’s original text, graphics, photographs, logos, and other content are owned by the Campaign or used with permission, unless otherwise indicated. You may not reproduce, distribute, modify, or commercially exploit Campaign content without permission, except as permitted by law.

Third-party names, trademarks, logos, photographs, and other materials remain the property of their respective owners.

9. Disclaimers

To the extent permitted by law, the website and its content are provided “as is” and “as available.” The Campaign does not warrant that the website will be uninterrupted, error-free, accurate, complete, or free of harmful components.

Campaign statements are not guarantees of future events, election results, employment outcomes, or other results. Website content is for general informational purposes and does not constitute legal, financial, employment, tax, or other professional advice.

Nothing in these Terms limits a right or remedy that cannot lawfully be limited.

10. Limitation of Liability

To the extent permitted by law, the Campaign and its representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of, or inability to use, the website or related services.

Nothing in these Terms excludes or limits liability where doing so is prohibited by law.

11. Changes

The Campaign may modify or discontinue website features and may update these Terms. Updated Terms will be posted on the website with a revised effective date. Continued use after revised Terms are posted constitutes acceptance to the extent permitted by law.

12. Governing Law

These Terms are governed by the laws of Texas, without regard to conflict-of-law principles, except where applicable federal law or NATCA election rules control.
